These Terms of Use (“Terms”) are between you and Volodymyr Dudchak, Private Entrepreneur (“we,” “us,” or “our”), the operator of the ArtCat iPhone app and artcat.app. By using ArtCat, you agree to these Terms. If you do not agree, please do not use the service.
1. Who can use ArtCat
You must be at least 13 years old, or the minimum age required by law where you live, to use ArtCat. If you are under the age of legal majority, a parent or guardian must review and agree to these Terms for you where required.
2. What ArtCat does
ArtCat organizes photos you permit it to access into possible museum visits and artwork collections. It uses photo metadata, on-device recognition, and a museum catalog to suggest matches. Results, artwork details, opening information, and location data may be incomplete or incorrect. Please confirm important details with the museum or another authoritative source before making plans or relying on a match.
3. Your photos and permissions
You control the photo access you grant through iOS. You are responsible for having the right to use photos and other material you choose to make available to ArtCat. You keep your rights in your photos and personal content. ArtCat does not claim ownership of them. Our Privacy Policy explains how the app handles photo information and other data.
4. Acceptable use
You may use ArtCat for lawful personal purposes. Do not misuse or interfere with the app, website, or catalog; attempt unauthorized access; submit malicious, unlawful, or infringing content; or use automated access in a way that harms the service or others. You may not copy or redistribute our software or proprietary content except as allowed by law or an applicable license.
5. Feedback and museum suggestions
If you send feedback or suggest a museum, you confirm that you may submit the text. You allow us to use the submission to operate and improve ArtCat and its catalog. Please do not include sensitive personal information in feedback. We may review, edit, or decline suggestions and are not required to act on them.
6. Purchases
Optional paid features, if offered, are purchased through Apple’s App Store. Prices, payment, refunds, and any renewal terms are shown in the App Store purchase flow and governed by Apple’s applicable terms. Availability and features may vary by location and app version.
7. Third-party information and links
ArtCat may show museum information, maps, photographs, source credits, and links supplied by third parties. Those parties are responsible for their own services and content. A link or museum listing does not mean we endorse the venue or guarantee its information.
8. Our intellectual property
The ArtCat name, artwork, interface, software, and website content are owned by us or our licensors, except for your content and materials identified as belonging to others. We give you a limited, personal, non-exclusive, non-transferable right to use ArtCat while you comply with these Terms. Third-party open-source components remain subject to their own licenses.
9. Availability and changes
We may update, change, pause, or discontinue parts of ArtCat. We aim to keep the service useful and available but cannot guarantee uninterrupted access or that every museum or artwork will be recognized. You are responsible for maintaining a compatible device and current app version.
10. Disclaimers and liability
ArtCat is provided “as is” and “as available,” to the extent permitted by law. We disclaim implied warranties to that extent. We are not liable for indirect or consequential losses arising from use of the service, and our total liability for claims relating to ArtCat is limited to the amount you paid for ArtCat in the 12 months before the claim, except where law does not allow such a limit. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
11. Ending use
You may stop using ArtCat at any time and remove it from your device. We may restrict access to online parts of the service if these Terms are violated or where necessary to protect the service or comply with law. Terms that by their nature should continue after use ends will continue.
12. Governing law and disputes
These Terms are governed by the laws of Ukraine, without limiting mandatory consumer protections that apply where you live. Please contact us first so we can try to resolve a concern. If we cannot, a dispute may be brought before a competent court as permitted by applicable law.
13. Changes to these Terms
We may revise these Terms. We will post the new version here with an updated date and provide additional notice if required. Continued use after revised Terms take effect means you accept them.
